These Terms of Service ("Terms") govern your access to and use of the website, API, and services (collectively, the "Service") provided by a-eye ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement and have the authority to enter into these Terms.

2. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately at contact@a-eye.com if you suspect unauthorized use of your account.

3. Use of the Service

The Service provides AI-powered content moderation, age verification, and behaviour analysis through a RESTful API and related tools. You may use the Service only for lawful purposes and in accordance with these Terms.

You are solely responsible for all content you submit to the Service and for ensuring your use complies with applicable laws and regulations, including child safety laws.

4. API Access and Free Tier

We provide 100,000 free API scans per month. Usage beyond the free tier is billed according to the pricing published on our website. We reserve the right to modify pricing or free tier limits with reasonable notice.

API keys are personal to your account and must not be shared, sold, or published. We may suspend or revoke access for misuse or violation of these Terms.

5. Prohibited Uses

You may not use the Service to:

• Violate any applicable law or regulation.
• Distribute, generate, or store child sexual abuse material (CSAM) or any illegal content.
• Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to circumvent rate limits, authentication, or security measures.
• Use the Service to build a competing product or service.
• Resell, sublicense, or redistribute the Service without our written consent.
• Use automated means to scrape, harvest, or collect data from the Service beyond authorized API usage.

6. Content Ownership

You retain ownership of all content you submit to the Service. By submitting content, you grant us a limited license to process, analyze, and use the content as necessary to provide and improve the Service, including the development of our detection models and technology.

7. Intellectual Property

The Service, including its design, features, algorithms, models, documentation, and branding, is owned by a-eye and protected by intellectual property laws. Nothing in these Terms grants you rights to our intellectual property except the limited right to use the Service as permitted herein.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that detection results will be accurate or complete. The Service is a tool to assist with content moderation and age estimation, and should not be the sole basis for legal, compliance, or safety decisions.

9. Limitation of Liability

To the maximum extent permitted by law, a-eye shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless a-eye and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 7, 8, 9, 10, and 12) will remain in effect.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Canada.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
